Abstract

The Spanish Constitutional Court has issued numerous judgments of high technical merit. It has established, for example, the basic concepts, such as equality of treatment (direct and indirect discrimination) and equal opportunities. However, the Court has not always used such theoretical concepts more precise. This paper critically examines all the jurisprudence of the Constitutional Court on the constitutional prohibition of discrimination based on gender (until 2010).
