This article, with the object of deepening in the content of the right to strike as a fundamental and human right, presents a comparative vision between four judicial decisions of high courts and an international human rights court in the matter of restrictions of the right to strike. In each case, the quality of the right as fundamental and the evaluation of the restrictive measure used by the court is analyzed, assessing how it influences the substantive decision reached.
