Abstract

This article is a study about the immigration of young people, it’s lack of recognition in Mexican legislation and the consequences of this situation in humans rights and the public policies. It defines what is it to be a young person and an immigrant not as a legal statement but as a situation, as a state of being, which is not always a voluntary state, but a forced change on the way of life for this people. The situation and the context makes it hard to define, but that is exactly what is missing in the human rights legislation. The main propose of this document is to introduce the need of categories instead of concepts for the legislative use in definitions of population, taking in consideration situations that expose vulnerability and the debarment of the young immigrants, in order to provide more effective policies in the humans right approach.
