In the present work an introductory analysis is carried out on the definition, content and development of international criminal law, which is essentially a substantive criminal law created by the international community with the purpose of sanctioning the crimes of greatest importance to humanity. Likewise, it analyzes its differences with the prescriptive jurisdiction, known in Mexico as “Derecho penal internacional”, which is a law of national origin by which states regulate the extent of their punitive power, in accordance with certain principles that are also studied.
