In this work, I propose to make an analysis of the institute of civil prescription in the new Argentinean Civil and Commercial Code and relate the enforcement of this institute to Crimes Against Humanity, especially the corporations and companies related to workers disappearances and murders with union insertions during the last military dictatorship (1976-1983).
Appealing upon various sources, including the doctrine, jurisprudence, law, and human rights instruments, among others, I propound the inadmissibility of the civil prescription, inapplicable to situations of gross violations of human rights, to evade corporate complicity and responsibility.
