The general objective of the study was to analyze the panorama of the seropositive people’s rights in relation to the world of work. For this purpose and in order to consolidate data alluding to Brazilian society, this review article started from secondary sources to elucidate the main legal frameworks since 1988, year of the promulgation of the current Federal Constitution. Thus, Brazilian laws and the positions of the International Labor Organization (ILO) on the rights of HIV positive people are presented, highlighting dimensions of a constant struggle to expand, maintain and guarantee these rights. Finally, there is a need for research that goes in the direction of investigating and reinforcing the guarantee of the right to work without discrimination for all people, including HIV positive people.
