Motivation as a constitutive element of due process and legal security constitutes a fundamental right expressly recognized in the constitutional text. In Ecuador, the jurisdictional function is essential for an adequate legal process, considered one of the primary purposes of the State; however, the limitless moral breakdown has caused justice to be questioned. In this sense, the objective of the investigation is to avoid the erroneous issuance of judgments, in order for justice to be timely and effective, respecting the basic guarantees of due process.
