This paper addresses the need of the Mexican state for institutional innovation as a means for improving both the whole public apparatus effectiveness and governance rooted in legal and democratic practices. The main hypothesis is that current deficiencies of the Mexican state are due more to an obsolete public legal structure -originally designed in a semi authoritarian political context- han to inadequate government management. This institutional obsolescence also affects negatively the quality of Mexico's democracy, it's whole public policy process and governance. The final proposal is the creation of a new program to take on institutional design that transcends a simple public process or public management upgrade and instead focuses mainly on the state's legal structure.
