Abstract
BAHIA, Amael Notini Moreira. The Definition of International Watercourses and the Silala Case. Anu. Mex. Der. Inter [online]. 2021, vol.21, pp.233-267. Epub Jan 21, 2022. ISSN 1870-4654. https://doi.org/10.22201/iij.24487872e.2021.21.15593.
This paper aims to understand the possible consequences of the classification or not of Silala, a water resource shared by Chile and Bolivia, in the legal definition of an international watercourse. The main hypothesis proposed is that the unitary whole element of the concept of international watercourses does not preclude Silala from fitting into this legal category. The element of the common terminus, on the other hand, makes necessary a factual analysis of the geographical characteristics of this transboundary water resource so that a clearer opinion can be given, since it is an index of reasonableness only verifiable in the face of a specific situation.
