Abstract

From the attacks that took place in the United States on September 11, 2001, terrorism extended its actions to the European continent, motivating the reaction of the governments that strengthened their security policies and adopted various strategies aimed at preventing attacks and punishing them severely responsible, also leading to a situation of fragility in respect of individual rights of individuals. In this article we will examine the criteria used by the European Court of Human Rights in the prosecution of the crime of torture based on the comparative analysis of rulings made before and after the attacks, a method that will allow us to sustain that the Court has maintained the absolute prohibition of torture.
