Abstract

AGUILAR CAVALLO, Gonzalo. The Obligation of the Control of Conventionality in the Light of the Law of Treaties. Anu. Mex. Der. Inter [online]. 2019, vol.19, pp.357-398.  Epub May 11, 2020. ISSN 1870-4654.  https://doi.org/10.22201/iij.24487872e.2019.19.13328.

This paper aims at examining whether there are international norms underlying the State obligation to carry out a control of conventionality within the domestic legal system. We argue that this international State obligation is based on articles 26 and 27 of the 1969 Vienna Convention on the Law of Treaties. This study examines the relevant literature and applies the interpretation principles provided for the Vienna Convention itself.

Keywords : control of conventionality; Inter-American Convention on Human Rights; Inter-American Court of Human Rights; principle of effectiveness; international interpretation.
