The constitution of the children and adolescents' rights has faced great oscillations in the international normative panorama. This is due to the fact that these rights have always g appear as a bargaining chip, especially when dealing with individuals involved with the criminal sphere. The internationalization of human rights and the humanized view of the criminal procedure were important and necessary changes to achieve legal and political progress in the childhood sphere. This article seeks to identify not only the evolution of those rights but also the treatment of the children and adolescents involved with juvenile justice system. For that, a bibliographical research is done as well as a comparative analysis of the laws data concerning this subject in the Latin American countries.
