The present article approaches the evolution of the European politics of immigration and his contradiction with European and world texts of protection to the human rights. He analyzes the beginning of the formation of the European Community and the decisions that led the communitarisation of the "problem" of the freedom of persons' traffic in the European Union territory, and his contemporary restrictions.
