This article provides a comprehensive analysis of the doctrine of the Inter-American Court of Human Rights regarding the fundamental human right to an independent judge and the protections necessary to safeguard this right, as developed in its jurisprudence. Its goal is to create a single conceptual model that accounts for all of the circumstances, conditions, acts and omissions of the governments of States party to the American Convention that have infringed upon its citizens right to an independent judge.
