Abstract

ARROCHA OLABUENAGA, Pablo. Considerations about the rule of law in the international level. Anu. Mex. Der. Inter [online]. 2010, vol.10, pp.173-197. ISSN 1870-4654.

This article puts forward some of the problems and implications that the expression 'rule of law' presents in the international level, making a special emphasis in its definition, its scope of application and the dimension that said expression acquires in practice. In this respect, an approach is made to tackle this subject on the dilemma it poses between legality and legitimacy at the international level, as well as the import tance of the role of the United Nations in it; it analyzes, in particular, the role of both the Security Council and the International Court of Justice in the creation and in the maintenance of the rule of law in the international level.

Keywords : international community; universal constitution; democracy; international rule of law; legality; legitimacy; principle of legality; sovereignty.
