Abstract

OROZCO GADEA, German A.. Comments about article 326 of the Family Code (notarial agreement on alimony). Rev. IUS [online]. 2015, vol.9, n.36, pp.419-440. ISSN 1870-2147.

In Nicaraguan legislation, with the implementation of the Family Code, parties are permitted to execute agreements before notaries to regulate the payment of alimony. These agreements must be approved by judicial authority. In the drafting of this type of convention, the notaries may find some vicissitudes, such as the capacity of minors to be parents; the situation of adolescents emancipated by maternity or paternity with regard to their right to receive food; the distribution of food in case of a plurality of food plans with other couples. With the spirit of contributing to a debate, we present our thoughts on this and other controversial issues in our legislation relative to the family.
