Abstract

ABELLA, Adriana N.. Public instruments in the civil and commercial code in Argentina. Rev. IUS [online]. 2015, vol.9, n.36, pp.359-387. ISSN 1870-2147.

Public documents are set forth and regulated in the Civil and Commercial Code of Argentina. It is of interest to distinguish the public documents, according to the agent and the content, for their consequences and effects; but all public documents must meet certain essential requirements. The competency of public official is particularly important by reason of the subject-matter, territory and person. The grounds for invalidity and substantiality are regulated by the new Code, with some innovations; as well as the probative value, and the free movement in defense of the rights of users and consumers, protected under constitutional rules and of the Civil and Commercial Code in Argentina. The signature on public documents and its projection in digital and electronic document is envisaged with special reference to the law of digital signature number 25,508.
