Abstract

CEBALLOS MOLANO, Raquel. Free trade agreements and intellectual property rights: a policy of trade integration in Colombia. Rev. IUS [online]. 2014, vol.8, n.33, pp.223-256. ISSN 1870-2147.

This article presents a critical analysis of the evolution of intellectual property rights in agreements and treaties in force in Colombia, and the clauses inserted in the integration and free trade treaties signed between 1960 and 2012. We used a descriptive methodology which allowed us to identify that Colombia, although it has acceded to various specific intellectual property treaties in accordance with obligations arising from numerous agreements with which the government hopes to promote the innovation and the competitiveness of the business sector to participate in international trade, does not favor internal productivity little developed in industrial products, but rich in biological diversity, forcing framing this policy under the constitutional guidelines and the Andean law prevalent in the field of intellectual property.

Keywords : Intellectual property rights; industrial property; copyright; commercial policy; integration agreements; free trade agreements.
