The European Union Member States struggle with how to apply the provisions relating to the Directive 89/104 of Trademarks and Regulation No. 40/94 on the Community trade mark, for advertising cases through keywords. The decisions of the European Union Court of Justice raise guidelines regarding the use of a trademark as keyword. These judgments are an important part of the determination of a legal framework on advertising through keywords that European national courts may use.
