The objective of this article is to formulate a critical review to the State actions about its international obligations in the area of social rights, in particular about minimum vital right. This concept, for its recent creation, still contains dilemmas concerning the means to realize it of the best way. The methods of abstraction and concretion and documentary techniques have been used. The results show a dissociation between the purpose of the minimum vital right and the assistance-based practices for which a significant amount of the public spending is destined.
