Abstract

CANO-NAVA, Martha Olivia. Epistemological model of the tridimensional law theory. Convergencia [online]. 2011, vol.18, n.57, pp.209-228. ISSN 2448-5799.

The problem of research in formal sciences is the use of epistemological basis as the "leading thread", that allows presenting results catalogued as scientific. Science is dynamic, which enables men to search and find explanations in his environment. In investigations regarding law, the problem of having integral theories of practical application has arisen; although complex theories are required to investigate it, theories that cover the totality of the elements that integrate it. This is the reason why the Tridimensional Law Theory by Miguel Reale presents us a solution. Whenever we revise a theory, its integrity to apply it to the objects of study is not always understood, which does not occur when we analyze theories regarding the factual sciences, which are generally presented in charts and whose understanding is highly objective. The present article comprises the analysis of the postulates and the method of the Tridimensional Law Theory, as well as its graphic representation regarded as an epistemological model that allows the clear seizing of the objects of study in order to provide appropriate results to the history, culture and values of the region, always on behalf of man.

Keywords : leading thread; tridimensional; dialectics; epistemological model; law; fact; value; norm; history; culture.
