The article talks about the position of women in the family surrounding, concerning their rights, with the objective of transcending the law. It proposes the personal developing of women, and to give priority to interests that exceed the domestic ambit. It supports the change of paradigm and the assumption of the gender equity, understood as the de mocratization of the relations between the masculine and the feminine. It assumes the modern family as a relational system that must be integrally studied and undertaken by the institutions, the State and the civil society. The article mentions several proposes of western countries to give a character of juridical or constitutional norm to the changes of the feminine and family condition.
