Abstract

MARZOUKA, Marcelo. State under occupation, law without sovereignty. Notes on the Palestinian legal system. Polít. cult. [online]. 2018, n.50, pp.107-126. ISSN 0188-7742.

This article analyzes the development of law in Palestine from a historic perspective, observing the legal and institutional influence of Islam, the Turkish Ottoman Empire since the Tanzimat reforms, as well as the effects of the British Mandate and the successive occupations of the Palestinian Territories during the 20th century. The appearance of a proper Palestinian law is suggested to happen starting from the creation of the Palestinian Legislative Council in 1995, discussing its legal nature, given the limited sovereignty that this people can exercise, its current state-of-art and some social practices of access to justice.
