Abstract

Despite the fact that it is a classical topic in sociology, not too many research projects empirically trace the consequences of the process of functional differentiation in modern society. Based on this assumption, this article attempts to explain the strategies for differentiating the legal ordering of contemporary society based on the theoretical premises of Niklas Luhmann's work. It also explores the consequences of the development of law in the context of a differentiated social order and the operating conditions the legitimation of the legal order must face.
