Abstract

RUIZ-RICO RUIZ, Catalina. Comparative analysis of Iberoamerican legislation on transparency and access to public information. Bol. Mex. Der. Comp. [online]. 2019, vol.52, n.154, pp.255-283.  Epub May 12, 2020. ISSN 2448-4873.  https://doi.org/10.22201/iij.24484873e.2019.154.14144.

The implementation of constitutional legitimacy for credibility and confidence in Latin American democratic systems is developed through legal and institutional transparency. Its consolidation as a constitutional right prevents weakening of other related basic rights, such as participation and freedom of information. The analysis of regulatory deficiencies of transparency from a territorial prism, subjective, objective and in relation to the limits poses legal challenges to its implementation in the Latin American context.

Keywords : Right to Information; Comparative Law; Limits of Transparency; Exceptions to the Right to Information; Constitutional Guarantees.
