Abstract

The European Regulation 650/2012 aims, among other goals, encourage the planning of succession in Europe. In this sense, it seems to line up with the latest trends on inheritance law, surpassing the old perspective of sustaining family needs to give way to considerations focused on the autonomy of the de cuius and the continuity of businesses. However, geographical constraints that is inevitably doomed and its own choices in selecting the applicable law compromise the achievement of those objectives.
