Abstract

After analyzing cases in international and Mexican Law it’s possible to obtain guidelines for interpreting and applying intellectual disability, new legal status of the disable, in the Chilean national legal system and probably to establish one of the “models” of solution for the application of international treaties in the national legal system, avoiding lacks of legal rules even by incompatibility because international treaties grant rights to disables, creating this new legal status but the Chilean legal rules declare them non-able.
