Based on a critical analysis of the key court decisions surrounding the possible annulment of the election of Demetrio Sodi as borough chief of Miguel Hidalgo in Mexico City in 2009, this article proposes a rethinking of election law in Mexico. It proposes taking up a Heideggerean "ontological" approach so as to facilitate the possible annulment of an election when there are generalized violations of electoral norms and principles. Specifically, one of the most common errors which judges commit is the mechanical and unthinking importation of principles from other areas of law, such as criminal, civil and administrative law, into electoral law.
