Abstract

In the present article the author, through the examination of the American Convention on Human Rights, case law of the Inter-American Court on Human Rights and other international conventions, discusses the most important decisions and criteria produced by said Court concerning the death penalty. The study of said materials allows the identification of the reach and applicability of new consulting opinions of the Court which are against the death penalty. As shown in the essay, in some cases it has been possible to see some progress not so much in the form of the aboilion of this kind of penalty, but in the form of a more modest step, which is the limitation of the death penalty to cases of intentional homicide.
