Abstract

FERNANDES, Edésio. Del Código Civil al Estatuto de la Ciudad: algunas notas sobre la trayectoria del derecho urbanístico en Brasil. Bol. Mex. Der. Comp. [online]. 2004, vol.37, n.109, pp.41-69. ISSN 2448-4873.

In this article the author examines some aspects of the process related to the conceptual and institutional construction of urban law in Brazil. To do so, he assumes that, given the gravity of the existing urban problems, the study of urban law in Brazil requires a discussion of the real legal possibilities as well as the concrete political and institutional practices related to urban management. For the same reason, the author asserts that the understanding of urban law requires not only the formal study of statutes and other urban law principles and legal instruments, but also the critical reflection on the process through which such statutes, principles and instruments are produced, and their relation with urban illegality.
