Abstract

OVALLE FAVELA, José. Acciones populares y acciones para la tutela de los intereses colectivos. Bol. Mex. Der. Comp. [online]. 2003, vol.36, n.107, pp.587-615. ISSN 2448-4873.

The aim of this essay is to make a comparative study on the rules that govern popular and class actions in Spain, Colombia, Central America and Mexico. In the first place, the author draws a distinction between concepts such as: collective interests, diffuse interests and group interests. Later on, he analyzes the rules on ''popular actions'' in Colombia, which protect collective interests and grupo interests. Thirdly, he explains the regulation of collective actions in Spain, as well as the rules that govern group actions in Mexico. Finally, the author concludes that the intruments which protect individual rights have not been able to give an answer to conflicts in which collective interests are involved.

Keywords : class actions; group actions; collective interests; diffuse interests.
