Abstract

As a result of the Statute of Rome's entrance into force, thus founding the bases of the International Criminal Court, the author examines in this article the domestic consequences that its ratification would entail in connection with Mexico. In the first part of the essay, the author explains the antecedents of the Statute and its content. In the second part, he exposes the way in which the Court works as well as the reasons that justify its creation. In the third part, he studies the contradictions that exist between the Mexican Constitution and the treaty, analyzing too the project of reform to article 21 of the Constitution, which seeks to avoid those contradictions. Finally, the author concludes with some proposals for reforming several constitutional rules, in order to adapt the Constitution to the Statute of Rome.
