Abstract

ZEPEDA LECUONA, Guillermo. Trajectory of the regimen of the application of preventive imprisonment in the 1917 Mexican Constitution. Intersticios sociales [online]. 2018, n.15, pp.207-240. ISSN 2007-4964.

The constitutional regulation of provisional liberty and preventive imprisonment have been subjects of intense debate and given rise, since the promulgation of the current Constitution, in 1917, to six distinct regimens that have governed these institutions: 1917-1948, 1948-1985, 1985-1993, 1993-1996, July 1996-June 2008, and from June 2008 to the present, with the new regimen incorporated by the constitutional reforms published on June 18, 2008. The article describes, briefly, the diverse institutional systems of provisional liberty and preventive imprisonment that have been enforced in the country since 1917, together with the contents and scope of the current regimen.

Keywords : preventive imprisonment; liberty during process; 1917 Constitution; constitutional reforms.
