Abstract

GUILLEN LOPEZ, Germán  and  ALVARADO MARTINEZ, Israel. The condition of the active subject as first-class aggravating factor in the drug trafficking (Spanish Criminal Code). Rev. IUS [online]. 2014, vol.8, n.34, pp.182-197. ISSN 1870-2147.

First, this paper reviews the Spanish legislative model to sanction drug trafficking. It also analyzes the elements that come together when the guilty of these demeanors is an authority, public official, social worker or teacher. To finish, it will study the arguments that support -from the dogmatic and jurisprudential point of view- this aggravating factor.
