Abstract

FARRERA BRAVO, Gonzalo. The judicialization of politics: The case of Mexico in comparative perspective. Rev. IUS [online]. 2012, vol.6, n.30, pp.172-203. ISSN 1870-2147.

The implications of the judicialization of politics have given to the Constitutional States new ways to solve their conflicts, either between formal powers, federal and local in nature and at the municipal level. This way of rationalizing social conflict has generated a very important logic that has given constitutional supremacy the relevance it deserves. Judicial independence has come to give a new character to the role of constitutional courts, as especially in our continent were mere appendages of the executive in turn. This scenario was unthinkable that the courts oppose the "political extravagances" of executives.

Keywords : Judicialization of politics; elections; elections inauthentic; Mexico; Mexican electoral system; electoral reform; democracy; State; electoral law.
