Abstract

This article develops a critical analysis of the concept of "legal tradition", which is one of the fundamental categories of comparative law. In this way, the author firstly examines the use of such concept in comparative law literature; later on, he studies the relationship between the "legal tradition" discourse and the trends towards the unification of law at an international level. In addition, he proposes a reclassification of legal systems within the framework of the theory of legal change. In sum, the essay represents a postmodern critique of the ethnocentric character of the dominant comparative law discourse, centered around the concept of "legal tradition".
