The article conducts an analysis concerning the vulnerability in the protection of personal data arising from the lack of a specialized legal framework capable of addressing technological advancements, particularly those devoid of an ethical perspective in their creation, promotion, and utilization. The focus is specifically on generative artificial intelligence, employing a human rights approach as an analytical framework. In this regard, it provides a profound understanding of the impact of this technology on daily life, encompassing both the public and private spheres. There in an emphasis on the concern regarding the lack of synchronization between regulatory developments and the rapid technological evolution. It is evident that governments have chosen a strategy of self-regulation by technology companies, thereby compromising the adequate protection of human rights, especially concerning the security of personal data, in an increasingly digitalized context. In conclusion, the study underscores the urgent need to update and strengthen regulatory frameworks to ensure effective protection of human rights in a continually expanding digital environment. The absence of clear and precise regulations poses significant challenges that require immediate attention to safeguard the privacy and security of data in the digital era.
