SOTO GUERRERO, Héctor Eduardo  and  UVALLE BERRONES, Ricardo. Distortion of the right of access to public information. Estud. derecho inf. [online]. 2024, n.18, pp.97-127.  Epub Aug 12, 2025. ISSN 2594-0082.  https://doi.org/10.22201/iij.25940082e.2024.18.18950.

This paper analyzes the restrictions on the transparency policy that result from the government attack against INAI. The results show that annual cost of INAI per Mexican is seven pesos and forty cents. The presidential veto power of the appointments of commissioners caused inoperative for 151 days at INAI and generated an accumulation of 5,994 review files. The presidential decree of May 18, 2023, on the restriction of information on public works violated the principle of maximum publicity. Proposals are offered to overcome the impasse and it is concluded that the lack of appointment of commissioners damages the guarantee of citizen to access to public information.

Keywords : distortion; right of access to information; transparency; INAI; restrictions.
