During the 2012-2018 sexennium, the president of Mexico controlled the legislative function of the Congress of the Union on human rights issues. Therefore, the principle of division of powers only existed in the legal discourse. In that context Analyze and criticize the control exercised by President Enrique Peña Nieto of the legislative function of the Legislative Power in Mexico. The critical analytical method is used as a point of view of critical criminology. As main result it is pointed out that in the presidency of Enrique Peña Nieto, reforms in the area of human rights responded to the political interests of the president and the senators of the republic. As a main conclusion during the presidential term of Enrique Peña Nieto, the legislative function of the Congress of the Union of Mexico in the matter of human rights was under the political power of the president, with this a subjective and particular reality was constructed from his interests.
