Abstract
CASTRO CORIA, Eva Grissel. Disciplinary sanctioning regimes in public universities in Mexico. Derecho glob. Estud. sobre derecho justicia [online]. 2026, vol.11, n.32, pp.319-345. Epub Apr 30, 2026. ISSN 2448-5136. https://doi.org/10.32870/dgedj.v11i32.727.
Public Universities in Mexico, being decentralized public organizations with autonomy, have the power to establish their disciplinary sanctioning regimes, respecting the human rights of students, in particular the right to education, the free development of personality and due process. For this reason, the objective of this research was to identify the disciplinary sanctioning regimes of universities and the protection of university rights. The proposed methodology uses a dichotomous variable to identify the regulatory basis, the type of sanction and the existence of an ombudsman regarding university rights. The results are expressed in percentages, highlighting those universities that use other regulations, and establish some type of sanction, outside the generality identified. It should be noted that the majority of these universities have disciplinary regulations that establish the offenses that can be sanctioned, as well as the types of sanctions that can be applied. The most common sanctions are suspension and expulsion. The investigation also found that some disciplinary regimes are not clearly defined. In conclusion, the need to have specific legal and disciplinary devices that are clear, fair and respectful of the human rights of students in public universities in Mexico stands out.
