The Spanish and Mexican legal system allows to testate in favor of the soul. however, keeping the soul as heir at present has been a challenge for Spain. An institution rooted in the past, in which the Catholic Church had greater influence and which is increasingly in disuse, is in need of a profound update to the demands of society. The aim of this study is to analyze the history of the institution over the years in Spain, delving into its essential aspects and examining its viability under a qualitative methodology, in which documentary research has been used, gathering reliable information from documents and bibliographic materials. The difficult task faced by both the testator and the persons designated by him/her, both in Mexico and in Spain, and the intervention of the Catholic Church and the civil authorities, are highlighted.
