Abstract

The purpose of this article is to develop a comparative analysis of the institutional framework and challenges of resocialization between Peru, Argentina, Chile and Colombia, as well as to support a progressive approach to this institution from a liberal egalitarian perspective. A qualitative interdisciplinary methodology is used under a hermeneutic paradigm, which includes comparative-legal and philosophical-legal methods, and the exploratory-descriptive level. The findings highlight the historical failure of resocialization as an aim of punishment in Latin America, attributed to a combination of ideological and contextual reasons. The ineffectiveness of prisons to resocialize is linked to the critical and permanent prison overcrowding, which collapses prison systems. In response to this, a resocializing approach inspired by the egalitarian liberalism of John Rawls is proposed, as a commitment to the essential respect for human dignity and the institutional protection of the fundamental rights of the prison population.
