The sentence T-085 of 2020, issued by the Constitutional Court studies the meaning and scope of the rights to education, privacy and the free development of the personality of pregnant women as subjects of special protection, making a constitutional examination between the guarantee of negative and positive rights. In such a way, that using principles, values and safeguarding of fundamental rights, it ensures a basic sphere of dignity, survival, or self-determination of a subject, which is why it is justified to prefer constitutional mandates over any rule that is contrary to them. In this way promoting not an assault on legal security but a broader and constitutionalized understanding of the legal order. The present analysis constitutes a study on the balance of rights in collision, making use of previous jurisprudence that is related to the object of study and using hermeneutics as a research method.
