Housing rental relationships have changed due to technological innovations and critical situations that have exacerbated their conflictual nature and their importance to social wellbeing. This article analyzes the conflictive nature of these relationships, the possible growth of the problem as a result of the pandemic caused by COVID-19, as well as the challenges to introduce legal reforms in Mexico aimed at regulating the housing rental market. A review of situations of tension or confrontation between tenants and owners, as well as national and state legislation, was carried out. These reviews made it possible to identify common problems and market regulation options aimed at reducing transaction costs and expanding the population’s freedom of choice of housing and the right to the city. Reforms are explored to develop local government capacities to monitor and inspect the quality of housing and to operate a digital platform for the conclusion of lease contracts that are recognized in courts.
