Resumen
VAZQUEZ SANCHEZ, Omar. Reflections on Toulmin’s argumentative model and its methodological, heuristic, educational and accountability advantages based on its application to three court cases. Rev. IUS [online]. 2025, vol.19, n.55, pp.229-252. Epub 05-Mayo-2025. ISSN 1870-2147. https://doi.org/10.35487/rius.v19i55.2024.1030.
In this paper we apply Toulmin’s model to three cases of the Mexican judicial system in order to note its argumentative utility; in this sense, the model is a valuable tool for analyzing, representing and evaluating the arguments used by judges in the justification of their decisions, but its benefits are also reflected in suggesting argumentative actions to improve the jurisdictional task. However, here we explore other areas in which the advantages of the model are also significant, especially if it is configured (1) as a methodological strategy, (2) as a heuristic tool, (3) as an educational material, and (4) as a mechanism for judicial accountability and access to justice.
