PATINO REYES, Alberto. First Sabbatarian case of the Supreme Court of Justice of the Nation in favor of Seventh Day Adventist Doctors. Rev. IUS [online]. 2025, vol.19, n.55, pp.75-96. Epub 05-Mayo-2025. ISSN 1870-2147. https://doi.org/10.35487/rius.v19i55.2024.999.
A total of seventeen physicians were seeking certification of their specialty before the Mexican Board of Ophthalmology and the Mexican Board of Otorhinolaryngology, in accordance with the General Health Law, but, due to their religious convictions, they could not take the corresponding exams on Saturdays. Therefore, they requested the National Regulatory Committee of Medical Specialties Councils to change the day to carry out the evaluation. However, their petition did not receive a favorable response, for which reason they filed an Amparo lawsuit alleging violation of the right to conscientious objection, which was dismissed. Finally, the Second Chamber of the Supreme Court of Justice of the Nation took up the Amparo and resolved, not the conscientious objection of the objecting doctors, but the indirect religious discrimination.
