Abstract

This article aims to realize a critical analysis according to the rational evidence theory, related to the jurisprudence which provides that in the amparo law, the parties cannot ask cross-examination to the expert or experts once they have rendered their expert opinion. The above, in order to make visible that such prohibition affects the right of defence of the parties, prevents the contradictions principle from being respected and reduces the evidential faculties of the amparo judge.
