Abstract

The article compares how the gender identity of trans women deprived of liberty in Colombia and Mexico has been legally protected. The argument that guides the development is that, despite the existence of multiple international and national instruments that protect the human rights of the trans population deprived of liberty, they do not find minimum validity in the reality of both countries. On the contrary, both in Colombia and in Mexico there is a profound non-observance of the minimum human rights criteria when determining the prison assignment of trans women.
