Abstract

This documentary research aims to demonstrate that the human right to double instance, established in article 8, section 2, paragraph h); of the American Convention on Human Rights, which essentially implies the right to appeal a ruling before a higher court or judge, must be instituted within the Mexican labor procedure. However, the existence of the Direct Amparo Trial as the last means of challenging the labor trial, this isn’t the resource referred to in the jurisprudence of the Inter-American Court of Human Rights, therefore, given the recent constitutional and legal labor reforms that they do not contemplate a means of challenge in the labor procedure, it is possible to propose the implementation of a double degree of jurisdiction in order to respect procedural human rights and make the administration of justice more efficient.
