Abstract

AGUILAR CAVALLO, Gonzalo. The Principle of Interpretation in Conformity with Fundamental Rights in the Chilean Case-law. Cuest. Const. [online]. 2019, n.41, pp.83-128.  Epub Apr 22, 2020. ISSN 1405-9193.  https://doi.org/10.22201/iij.24484881e.2019.41.13942.

The development of specific principles of interpretation of human rights is a major feature of the contemporary constitutionalism. The “interpretation in conformity with human rights” is one of these principles. This paper aims at analyzing the incorporation of this principle by the Chilean Supreme Court. We argue that the Supreme Court is increasingly using this principle in order to enhance the protection of human rights.

Keywords : Constitutionalism; fundamental rights; constitutional paradigm; human rights interpretation.
